The purpose of these Parking and Traffic Regulations (the “Regulations”) is to ensure maximum use of available parking space on the property and grounds of RRC Polytech, and to facilitate movement of traffic on College roads and property in a safe manner. The College grounds are under the control and management of RRC Polytech (the “College”) for the purposes of regulating parking and traffic, and the College reserves the right to regulate and control all traffic and parking on its grounds and to take action for violations of these Regulations.
Authority for these Regulations, and for their enforcement, is contained in the following:
These Regulations may be amended by the College from time to time. Notice of any amendments to these Regulations shall be deemed to have been given to the College community and the public by publishing such amendment on the College’s website.
The Vice-President, Finance and Administration is responsible for the overall administration and enforcement of these Regulations and may delegate or assign responsibilities respecting the administration and enforcement to other College Enforcement Staff.
These Regulations apply to;
All persons to which these Regulations apply, are responsible for complying with these Regulations. Copies of these Regulations are available for inspection at the Commuting and Parking office, and on the College website.
The College shall collect such personal information of individuals parking pursuant to these Regulations, including without limitation name, vehicle information and payment information for the purposes of facilitating parking on College Property or enforcing the College’s rights under these Regulations. Individuals that park on College property consent to the collection, use and disclosure of information by the College as set out herein for the purposes identified and where required by law.
No person shall leave or park a bicycle on College property except in racks, bicycle lockers provided or in designated areas set aside by the College for this purpose.
No bicycle traffic or Motor Vehicle traffic of any kind is permitted on areas commonly used as pedestrian walkways.
Riding skateboards is prohibited on College property.
With the exception of designated areas assigned to the RRC Polytech Early Childhood Centre Inc., no person shall ride upon or use any coaster, sleigh, skis, skates, toy vehicles or similar devices on College property.
Any Motor Vehicle or bicycle, operated, used or parked on College property including any contents within such Motor Vehicle or bicycle, shall be solely at the risk of the owner or operator.
The College, the Board and their officers, employees and agents are not liable for any injury to any person (including death) or for any damage to or loss of property (including damage to or loss of a Motor Vehicle or a bicycle or its contents) arising from the use, operation, parking or standing of any Motor Vehicle or bicycle on College property.
The College, the Board and their officers, employees and agents are not liable for any inconvenience, loss or damage resulting, directly or indirectly, from:
Any person wanting to park a Motor Vehicle on College property is required to apply for a Parking Permit and pay the appropriate fees as outlined in Schedule “A” to these Regulations.
If a member of the College Community has a documented disability that requires them to be assigned a parking location with priority, they have the option to apply for an accessible Parking Permit. Any person applying for priority parking based on a disability will need to provide supporting documentation, as deemed acceptable by the College, to show the requirement for priority assignment and the expected duration of this requirement.
Every eligible person requiring a Parking Permit shall create a profile on T2 Flex and complete a vehicle registration in their profile that identifies each Motor Vehicle (including but not limited to model, year, colour and license plate) to be registered under these Regulations and containing such other information as may be required by the College.
Only one active Parking Permit shall be issued to each eligible applicant, regardless of the number of Motor Vehicles registered under these Regulations.
A Parking Permit shall be issued to the holder for a specified period of time, and is not subject to automatic renewal.
The holder of a Parking Permit shall not resell or assign the Parking Permit to any other person without the consent of the College.
A holder of an active accessible Parking Permit who finds accessible parking stalls illegally occupied or blocked, shall contact a member of the College Enforcement Staff at 204-632-3755, for further inspection and appropriate action.
The College may cancel a Parking Permit at any time:
Any person wishing to temporarily park a Motor Vehicle in a parking area shall first purchase a Temporary Parking Permit from the Parking Permit Dispenser or the Parking app.
An active Temporary Parking Permit purchased from a Permit Parking Dispenser or Parking app authorizes the holder of the Temporary Parking Permit to park a Motor Vehicle subject to the holder observing and complying with all the terms and conditions specified on the signage located at or near the Parking Permit Dispenser.
College employees and students may purchase a monthly Parking Permit online or in-person at the Commuting and Parking office.
Any Parking Permit issued is valid from the date it is indicated on the parking profile of the holder until the expiry date of the permit, between the hours of 07:00 hours and 23:59 hours.
All parking is on a scramble basis. An active Parking Permit authorizes the holder to park his or her Registered Motor Vehicle in any stall in the parking area provided it corresponds to the zone as designated on their issued permit.
Employees of any subtenant of the College or of any other person, business or corporation permitted by the College to carry on business or other activities on College grounds or property may apply for a monthly Parking Permit.
Visitors to the College are subject to payment of the applicable parking fee, park in the designated parking zones on College property, or any other area, as directed by College Enforcement Staff.
Contractors or tradespeople carrying out authorized construction, maintenance or repair work on College property shall make prior arrangements for parking on College grounds or property with the Commuting and Parking office and are required to purchase the necessary parking permits for any vehicles that will be parked on College property. Any expense incurred for parking will be the responsibility of the company, contractor or tradesperson and is not eligible for reimbursement through the College.
The organizer of a conference, seminar or meeting on College property shall make prior arrangements for parking of invited guests on College property with the Commuting and Parking office.
Electricity is supplied to powered parking stalls on a seasonal basis, depending on climatic conditions and may be powered down at the sole discretion of the College at any time based upon operational needs.
An electrical outlet in a parking stall is designated for the exclusive use of the holder of a Parking Permit authorized to park in that spot. The holder of the Parking Permit may utilize the electrical outlet for the use of a block heater, electrical vehicle (EV) or for a diesel-powered vehicle of a Registered Motor Vehicle.
No person shall use an electrical outlet in a parking stall for anything other than a block heater, EV or diesel-powered vehicle. Without limiting the foregoing, no person shall use an electrical outlet in a parking stall for an interior car warmer, battery blanket or other device.
Any person who has reason to believe that the electrical outlet is faulty must report this as soon as possible to College Enforcement Staff.
The holder of a Parking Permit and any other person parking a Motor Vehicle on College property shall pay the applicable fee(s) set out in Schedule “A” attached to these Regulations.
The College may refund the fee paid by a College Employee or student for a Parking Permit in proportion to the unexpired period of the Parking Permit less the Administration fee of $30. A permit with an unexpired period of two weeks will not be refunded:
The College, in its discretion, may partially refund a fee paid by a College employee or student for a Parking Permit. Any refund under this provision shall be payable to the person to whom the Parking Permit was originally issued. No refunds will be made with respect to daily Parking Permits.
The College shall refund a fee paid by an employee of a subtenant of the College or of any other person, business or corporation permitted to carry on business or activities on College property by the College, in proportion to the unexpired period of the Parking Permit less the Administration fee of $30. A permit with an unexpired period of two weeks or less will not be refunded.
If a Parking Permit Dispenser is faulty, users will receive a virtual permit for the equivalent parking time.
Outstanding fees and/or Fines shall be deducted and retained by the College for any refund provided as per Sections 8.02 to 8.05.
No person shall park or stand a Motor Vehicle upon any part of College property, including any roadway, driveway or approach in or on College property, except as specifically authorized by a valid Parking Permit issued under these Regulations or as otherwise authorized under these Regulations.
The College has the right to remove and/or impound a Motor Vehicle or bicycle on College property if such Motor Vehicle or bicycle is parked or used in contravention of these Regulations. This right also extends to Motor Vehicles that have unpaid fines.
No person shall park or leave a Motor Vehicle on any part of College property designated as a fire lane, a no parking area, alongside any building on College property, or in a zone other than the zone designated by their permit, as long as it’s not obstructing walkways or entrances, unless specifically authorized by a valid Parking Permit issued under these Regulations or as otherwise authorized by the College.
No person shall park or stand a Motor Vehicle except as authorized by the College:
No person shall park in a designated accessible parking stall without displaying a legally-issued placard indicating a right to park in such a stall, including possessing an Accessible Parking Permit issued by the College. A vehicle parked in a designated accessible spot without a legally-issued approval will be subject to immediate removal and/or a citation.
No person shall park or stand a Motor Vehicle in the Visitor/Daily Parking area except:
No person shall park a Motor Vehicle in a 24-hour reserved parking area on College property unless authorized by the College.
With the exception of training related to Motor Vehicles, no person shall wash, clean, or perform maintenance services on a Motor Vehicle on College property, other than emergency maintenance services required by reason of a sudden malfunction of the Motor Vehicle or as authorized by the College.
No person shall park or stand a Motor Vehicle on College property between the hours of 12:01 AM and 6:00 AM of any day unless authorized to do so by the College (including weekends and statutory holidays).
No person shall obstruct, temporarily or otherwise, the movement of vehicular traffic within, entering into or exiting from a parking area, loading area or parking stall on College property.
No person shall, add to, deface, damage, destroy, remove from a Motor Vehicle or obliterate any portion of a College Parking Citation or offence notice other than the owner or operator of the relevant Motor Vehicle for the purpose of the owner or operator holding the College Parking Citation in safekeeping and for the prompt payment of any fine specified in such College Parking Citation.
The College may, at any time, erect temporary “Lot Closed for Maintenance” signs in areas (normally allotted for parking under these Regulations) for the purpose of snow removal, cleaning, construction, special events, or for such other purpose as the College may consider reasonable at its sole discretion absolutely. Such “Lot Closed” signs shall have priority over any and all other parking privileges. Where reasonably possible, the Vice-President or his or her delegate will endeavor to assign persons temporarily displaced by the temporary “Lot Closed” restriction to other locations on the College’s property as may be available and will attempt to provide reasonable notice.
No person shall park or stand a Motor Vehicle on College property in any area which has been designated as a temporary “Lot Closed” area in accordance with subsection 10.01 of these Regulations.
All persons using, operating or parking a Motor Vehicle or bicycle on College property shall comply with the provisions of The Highway Traffic Act C.C.S.M. c.H60 and with any other applicable legislation.
Without limiting the generality of Section 11.01, the owner or operator of any Motor Vehicle used or operated on College property shall ensure that the Motor Vehicle is registered, licensed and insured for the current year, and that a valid license plate is displayed on the vehicle, as required by The Highway Traffic Act.
Without limiting the generality of Section 11.01, the operator of any Motor Vehicle used or operated on College property shall be a licensed driver under The Highway Traffic Act.
No person shall operate a snowmobile or all terrain vehicles on College property unless specifically authorized by the College.
No person using or operating a Motor Vehicle on College property shall disobey any traffic control device, including a traffic or parking sign, posted or erected on College property.
No person shall move, deface, alter, or in any way tamper with any traffic control device, including traffic or parking signs, posted or erected on College property.
No person shall operate a Motor Vehicle on College property at a rate of speed greater than is reasonable and prudent in the circumstances, having regard for actual and potential hazards, but in no event shall the rate of speed exceed 30 kilometres per hour.
Every owner or operator of a Motor Vehicle or bicycle on College property shall at all times give pedestrians the right-of-way.
In addition to complying with the requirements of The Highway Traffic Act and any other applicable law, any person involved in an accident or collision occurring on College property involving a Motor Vehicle and resulting in personal injury or damage to property shall immediately report such accident to College Enforcement Staff.
A member of the College Enforcement Staff may issue a College Parking Citation with an assessed fine consistent with these Regulations to any owner or operator of a Motor Vehicle who has violated or who is found to be violating any provision of these Regulations.
Fines shall be paid to the College for a violation of these Regulations in accordance with the rates and procedures set out in Schedule “B” attached to these Regulations. The College reserves the right to amend, increase or institute additional fines to those set out at Schedule “B” to these Regulations.
Where a College Parking Citation has been issued in respect of a Motor Vehicle, the owner or operator of such Motor Vehicle shall pay the applicable amount of the Fine shown on the Citation either online or in-person at the Commuting and Parking office.
The criteria for the removal of a vehicle is listed below:
As per Section 9.02, in addition to any other penalty or action, the College may, in accordance with City of Winnipeg By-law No. 6549/95 (or any by-law replacing it) have any Motor Vehicle which is parked or standing in contravention of these regulations removed and impounded. The owner or driver of the Motor Vehicle shall be required to pay all charges associated with the towing, storage and impoundment of the vehicle, along with all outstanding parking tickets associated with the vehicle, before the vehicle will be released.
In addition to any other penalty or action, members of the College Enforcement Staff are hereby authorized to initiate a complaint under City of Winnipeg By-law No. 6549/95 (or any by-law which may replace it) against the owner or driver of a Motor Vehicle parked or standing on College property in violation of these Regulations, or to report such a violation to a police officer for proceedings under the City By-law.
Failure by a student to pay a Parking Fee or Fine shall result in the cancellation of his or her parking privileges in accordance with Section 4.09. It may also result in the student’s mark transcripts, diplomas or certificates being withheld until such time as the amount due under the Fee is paid in full. A student may also be subject to disciplinary action as per College policy for non-payment. Unpaid parking fines will be sent to a collections agency for resolution.
Failure by an Employee to pay a Parking Fee or Fine may result in the cancellation of their parking privileges as outlined in subsection 4.09. This failure to comply may also lead to disciplinary action in accordance with the provisions of any applicable collective agreement, employment agreement, or College policy.
The College may arrange a voluntary payroll deduction payment plan for Employee Parking. If an Employee signs up a payroll deduction and a payment is missed, the College may deduct the outstanding balance then owing by the Employee.
Appeals related to the assessment and payment of Parking Fees or Fines may be submitted online. Appeals must be submitted with-in 15 days from the date of issue of the ticket. The College Parking Citation to be appealed must be paid prior to the appeal submission. A re-appeal may be submitted within 15 days of notification of the first appeal.
These Regulations come into effect on June 21, 2021, and will remain in effect until changed by resolution of the Board of Governors of the College.
